    Welcome to Cajun Palms Hotspot's Wi-Fi Network. To use this network, you must accept the terms of use outlined in the Cajun Palms Hotspot Wi-Fi Service Agreement/Terms of Use below. If you do not accept these Terms and Conditions, you will not be able to log in and access the Internet. Our Wireless Internet service is a best effort network and available ONLY to checked in campers and paid guests on day passes. Internet Connections require your acceptance of our Internet Use Policy which is strictly enforced. Any and all violations of our Internet Use Policy will result in immediate termination of your access to our hotspot, no exceptions and no refunds under any circumstances.

Cajun Palms Hotspot Wi-Fi Service Agreement / Terms of Use, Please read this agreement carefully before using our Wi-Fi Services.

This is an agreement between you and Cajun Palms Hotspot and its subsidiaries and or affiliate ("Cajun Palms Hotspot", "we", "us", "our") for your use of our wireless local area network communication services ("Wi-Fi", "the Service"). As a Cajun Palms Hotspot customer, you have agreed to the Cajun Palms Hotspot Terms and Conditions (http://www.cajunpalms.com/wifi_hotspot_terms.htm) which remain in effect. They apply to your use of Cajun Palms Hotspot Wi-Fi service along with the additional terms set forth below. By either acknowledging this agreement and/or using/activating the Service, you agree to these terms unconditionally.

REQUIRED DEVICES AND SERVICE AVAILABILITY A laptop, pocket PC or handheld device ("your Device") with Wi-Fi 802.11b wireless capability is required to use the service. You need to ensure that your Device is compatible with 802.11b Wi-Fi service. Availability of the Service is subject to all memory, storage and other limitations of your Device. Our system requires you use a 802.11 g or b network interface card to access the HotSpot from any line of sight point to our antenna located on the Clubhouse. We have Windows based D-Link PCI 32-bit Cardbus Adapters and D-Link USB WirelessG Adapters available to rent for a nominal fee during your stay if your laptop is not equipped with a 802.11 g or b network interface card. The Service is subject to unavailability, including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair. The Service may be interrupted, refused, limited or curtailed.

We are not responsible for data, messages or pages lost, not delivered or misdirected because of interruptions or performance issues with the Service, or the underlying network(s) and transmission equipment and systems. The accuracy and timeliness of data received is not guaranteed. Delays, omissions, lost/dropped packets, may occur. Actual network speed will vary based on your device configuration, location, compression, network congestion and other factors.

SUBSCRIPTION REQUIREMENTS
All Customers must be at least 18 years old. Access points or Wi-Fi Gateways  may not be available in all areas. Cajun Palms Hotspot reserves the right to change prices, institute new fees, change plans, or retire features, at any time. All Customers must provide Cajun Palms Hotspot with accurate and complete billing information including legal name, address, telephone number, and credit card/billing information. Customers are solely responsible for any and all charges to their account.

Current prices for Cajun Palms Hotspot Services:

Any Customers having questions regarding charges to an account should contact Cajun Palms Hotspot's Customer Service Department by email at support@cajunpalms.com. All charges are considered valid unless disputed in writing within 10 days of the billing date. Adjustments will not be made for charges that are more than 10 days old.

Charges are billed to Customers' credit cards each term for the applicable service plan and any additional usage or services. Cajun Palms Hotspot is not responsible for any charges or expenses (e.g., for overdrawn accounts, exceeding credit card limits, etc.) resulting from charges billed by Cajun Palms Hotspot. Delinquent accounts may be suspended or canceled at Cajun Palms Hotspot's sole discretion; however, charges will continue to accrue until the account is canceled and collection, late or other similar fees may be added. Cajun Palms Hotspot may bill an additional charge to reinstate a suspended account at our discretion.

CUSTOMERS ACCOUNTS, PASSWORDS, AND SECURITY 
Upon registration in our welcome center or online, you will receive a username and password. You are the only authorized Customer of your Cajun Palms Hotspot account, except if expressly specified otherwise in your service plan, and you must comply with this Agreement. Cajun Palms Hotspot service is sold per user restricted to one device, You may not share your IP address or ISP internet connection with anyone, access the Service simultaneously through multiple units, or authorize any other individual or entity to use the Service. You are required keep your password confidential so that no one else may access the Services through your account. Please notify Cajun Palms Hotspot immediately upon discovering any unauthorized use of your account. User names and passwords are Cajun Palms Hotspot's property, and we may change or replace them.

You may not use the Service for any purpose that's unlawful, or in any manner that could damage our property or others' property. You may not use the Service in any way that interferes with, harms or disrupts our system or other users. We have the right, but not the obligation, to suspend or terminate your access and use of the Service, and to block or remove (in whole or in part) any communications and materials transmitted through our Service that we believe in our sole discretion may violate applicable law, this Agreement or a third party's rights, or that is otherwise inappropriate or unacceptable. We also have the right, but not the obligation, to monitor, intercept and disclose any transmissions over or using our facilities, and to provide subscriber billing, account, or use records, and related information under certain circumstances, such as response to lawful process, orders, warrants or subpoenas, or to protect our rights, property and users.

Wireless systems transmit voice and data communications over a complex network. The privacy and security of such voice and data transmissions cannot be guaranteed. You acknowledge that the Service is not inherently secure, and you understand that wireless communications can be intercepted by equipment and software designed for that purpose. We are not liable to you or any other party for any lack of privacy you experience while using the Service.

You agree to accept the network configurations assigned by the Cajun Palms Hotspot's access points and/or routers, including but not limited to: ip address', subnet masks, default gateways, and/or domain name servers. Intentionally or unintentionally circumventing or attempting to circumvent any security settings, network settings, or client isolation features is strictly prohibited.

CONTENT DISCLAIMER
We do not exercise editorial control or review over the content of any Web site, electronic mail transmission, newsgroup, or other material created or accessible over or through the Services. However, we may remove, block, filter, or restrict by any other means any materials that, in our sole discretion, may be illegal, may subject Cajun Palms Hotspot to liability or may violate this agreement.

The following constitute violations of this agreement, (this list is intended to be illustrative and not exhaustive; other uses may violate this agreement and Cajun Palms Hotspot remains the sole and final arbiter of acceptable usage of its Services)

You agree to not use the Services to:
(a) transmit any material (by uploading, posting, email or otherwise) that is unlawful, threatening, abusive, harassing, defamatory, obscene, libelous, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable;

(b) harm, or attempt to harm, minors in any way;

(c) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted through the Services;

(d) transmit any material (by uploading, posting, email or otherwise) that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(e) transmit any material (by uploading, posting, email or otherwise) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

(f) transmit (by uploading, posting, email or otherwise) any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

(g) transmit any material (by uploading, posting, email or otherwise) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

(h) use the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent;

(i) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

(j) intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, Sales tax or other tax laws or fees, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;

(k) "stalk" or otherwise harass another; or collect or store, or attempt to collect or store, personal data about third parties without their knowledge or consent;

(l) resell the Services without Cajun Palms Hotspot's authorization;

(m) use the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes", unregistered sales of securities, securities fraud and "chain letters.";

(n) adding, removing or modifying identifying network, message, or article header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation;

(o) use the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email, whether or not that email is commercial in nature, are prohibited. Using deliberately misleading headers in e-mails sent to multiple parties is prohibited;

(p) use the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Cajun Palms Hotspot or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in disruption of service or the corruption or loss of data;

(q) use the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software;

HIGH VOLUME, Server Hosting, and non-traditional end user activities:
The Services are intended for an end user's periodic active use of email, instant messaging, browsing the World Wide Web, and other typical end user activities. High volume data transfers, especially sustained high volume data transfers, are prohibited. Hosting a web server, IRC server, or any other server is prohibited. Accordingly, Cajun Palms Hotspot maintains the right to terminate any user's connection following the detection of any high volume data transfer, server hosting, or non-traditional end user activity as determined at the sole discretion Cajun Palms Hotspot's Staff.

Cajun Palms Hotspot requires that anyone who believes that there is a violation of this agreement direct the information to: support@cajunpalms.com. If available, please provide the following information: (i) the IP address used to commit the alleged violation; (ii) the date and time of the alleged violation, and (iii) evidence of the alleged violation.

Cajun Palms Hotspot may take any one or more of the following actions, or other actions not listed, at Cajun Palms Hotspot' sole discretion in response to complaints: (i) issue warnings: written or verbal; (ii) suspend the Customer's account; (iii) terminate the Customer's account; (iv) bill the Customer or user for administrative costs and/or reactivation charges, with a minimum administrative cost; or (v) bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

DISCLAIMER OF WARRANTIES
Cajun Palms Hotspot is providing the Service on an "as is" and "as available" basis, with no warranties whatsoever. In no event will we be liable for any direct, indirect, incidental, consequential, special, exemplary or any damages associated with your use of the Service. No advice given by Cajun Palms Hotspot or our representatives shall create a warranty. You assume all responsibility and risk associated with your use of the Service. Any and all violations of our Internet Use Policy will result in immediate termination of your access to our hotspot, no exceptions and no refunds under any circumstances.
